1. Acceptance of Terms

By using DRYVE Automotive's mobile repair services, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Platform Role — Dispatch and Logistics

Important Disclosure

DRYVE is a dispatch and logistics platform that connects customers with independent contractor mechanics. DRYVE does not itself provide automotive repair services and is not a repair shop. The technicians who service your vehicle are independent contractors, not employees of DRYVE.

Services facilitated through the DRYVE platform include:

  • On-site vehicle diagnostics performed by independent contractor mechanics
  • Mobile repair and maintenance services at your location
  • Parts sourcing and installation coordination
  • Emergency roadside assistance dispatch

3. Independent Contractor Mechanics (California)

All mechanics who perform services through the DRYVE platform are independent contractors, not employees, agents, or representatives of DRYVE Automotive LLC. This classification applies to services performed in California.

  • DRYVE is not responsible for the acts, omissions, or negligence of any independent contractor mechanic.
  • Independent contractors carry their own insurance and are solely responsible for the quality of their workmanship.
  • DRYVE facilitates the connection between customers and mechanics but does not control the manner in which repairs are performed.
  • Any warranty on labor is provided by the individual contractor through the DRYVE platform's warranty policy and is not a warranty from DRYVE itself.

4. SMS/Text Messaging Terms

By providing your mobile phone number and opting in to receive SMS messages from DRYVE Automotive, you consent to receive conversational, informational, and service-related text messages from us, including:

  • Appointment confirmations and reminders
  • Mechanic arrival notifications
  • Service updates and status changes
  • Payment confirmations
  • Customer support communications

SMS Opt-Out and Support:

  • Reply STOP to unsubscribe from text messages at any time
  • Reply HELP for customer support or call (858) 477-4920
  • Message and data rates may apply based on your carrier plan
  • Message frequency varies based on your service appointments

We use RingCentral for SMS delivery. Your consent and contact information will NOT be shared with third parties for marketing purposes.

5. Service Estimates and Authorization

In compliance with California's Automotive Repair Act, including Business and Professions Code § 9884.9:

  • Written estimates describing labor and parts will be provided before work begins when required
  • Customer authorization is required before repair work or charges begin
  • Additional repairs discovered during service require separate authorization
  • All estimates include parts, labor, and applicable taxes

6. Payment Terms

Payment terms include:

  • Diagnostic fees: $140 for standard service, $190 for priority or same-day service, and $220 for emergency roadside service
  • Payment due upon service completion unless otherwise agreed
  • Accepted payment methods: Credit/Debit cards via Stripe, Cash
  • Service fee of 3.4% + $0.40 applies to card transactions
  • Refunds processed for cancelled services (subject to parts costs incurred)

7. Cancellation Policy

  • Appointments may be cancelled up to 2 hours before scheduled time without penalty
  • Late cancellations may incur diagnostic fee charge
  • Parts ordered on your behalf are non-refundable if cancellation occurs after ordering

8. Warranty and Liability

DRYVE Automotive provides a 90-day warranty on labor for completed repairs. Parts warranties are covered by manufacturer terms. We are not liable for:

  • Pre-existing vehicle conditions not disclosed by customer
  • Damage resulting from customer negligence or improper vehicle use
  • Consequential damages or lost profits
  • Services performed by third parties

9. Customer Responsibilities

  • Provide accurate vehicle and contact information
  • Ensure safe access to vehicle for service
  • Present valid driver's license and vehicle registration when required
  • Authorize all repairs before work commences
  • Make timely payment for services rendered

10. Privacy and Data Protection

Your personal information is handled according to our Privacy Policy. We collect and use your data solely for service delivery and comply with all applicable privacy laws.

11. Dispute Resolution and Governing Law

Any disputes arising from these Terms of Service will be resolved through binding arbitration administered in San Diego County, California. The arbitration shall be conducted under the rules of a mutually agreed-upon arbitration service. The arbitrator's award shall be final and binding.

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any matters not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state and federal courts located in San Diego County, California.

Nothing in this section limits your right to pursue a claim with the California Bureau of Automotive Repair, the California Attorney General's office, or any applicable consumer protection agency.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of updated terms.
